Conditions of Hire

1. Booking
A booking is confirmed when the Deposit of 25% of the Hire Charge (to the nearest £) has been received and a receipt issued by the Company. The balance of the Hire Charge is payable 6 weeks before the holiday departure date.
2. Under the age of 20
The Company cannot accept a booking from a person under 20 years of age.
3. Cancellation
In the event of the Hirer having to cancel a booking every effort will be made to re-let the whole or part of the period booked at the best possible price. If we are successful in re-letting the boat at the booked rate the Hirer is then only charged 10% of the booked rate. If we are unsuccessful in re-letting the booking, or only obtain part of the booked rate, the Hirer remains responsible for the balance of the booked Hire Charge.
4. Cancellation Insurance
In the best interests of the Hirer the Cancellation Insurance detailed below is obligatory and has already been included in the holiday cost.
5. Commencement of Holiday
Boats may be collected at 15.00 hours on the start day. Full instructions on the boat and its equipment will be given to each party. For beginners and others on request, comprehensive tuition on boat handling is provided with accompaniment through Preston Brook Tunnel and Dutton stop lock.
6. Return of Boats
Boats must be returned by 09.00 hours and vacated not later than 09.30 hours in a clean condition. If boats are returned in a dirty condition the Company reserves the right to charge for any extra cleaning that is necessary. The Hirer is responsible for allowing sufficient time to return to the boat yard at the stated time, paying particular note to the navigation times of the Preston Brook Tunnel. If boats are not returned on time a charge of £10.00 per hour may have to be made.
7. Company Insurance
Whilst the Company provide insurance cover against loss of or damage to the boat and equipment and against public liability claims, the Company reserves the right to charge the Hirer for malicious, negligent or intentional damage.
8. Inventory and Equipment
It is the Hirer's responsibility to check the Inventory List and report any missing or damaged items. The Hirer is responsible for returning the Inventory and Equipment in the same condition.
9. Delays
The Company cannot he held responsible for any delays or non-fulfilment of programmes caused by breakdown, unforeseen defects, obstructions, repairs or damage, to either our boats or the Inland Waterways system. We also reserve the right to restrict the cruising area without notice if unusual conditions arise and make no financial adjustment.
10. Waterways restrictions
In the event of Canal Closure, due to unforeseen circumstances, the Company reserves the right to operate from alternative bases as circumstances allow without making any financial adjustment.
11. Wastage of Water
The hirer is responsible for any wastage of water or damage caused by negligent use of lock paddles or other property resulting in a claim by the Water Authorities.
12. Accidents
The Hirer Is responsible for the safe navigation of the boat and is in complete charge. In the event of an accident the Hirer must notify the Company as quickly as possible with full details and names and addresses of witnesses. DO NOT PREJUDGE THE CASE BY ADMITTING LIABILITY
13. Navigation Limitations
The Hirer must not navigate in the hours of darkness or in fog. The Hirer shall not tow other boats or enter river or tidal waters without consent of the Company.
14. Car Parking
The Company provide outdoor parking free of charge. Although we make every effort to ensure that no damage or loss occurs, the Company cannot accept liability.
15. Company Reservations
The Company reserves the right to refuse to hand over a boat to any person who in the Company's opinion, is not suitable to take charge. In such circumstances the sum paid by the Hirer will be refunded in full and no further claim shall be made against The Company. If the Company is unable to provide the boat booked or a suitable alternative, owing to circumstances beyond our control, the Company will refund the sum paid by the Hirer and no further claim shall be made against the Company.
16. Online Brochure
The descriptions of the boats in this online brochure are generally accurate but the Company will not be liable for any minor inaccuracy that may exist. Maps and plans are not to scale.
17. VAT
VAT is included in the prices at the prevailing rate. If this rate changes prior to payment of deposit and/or final balance the Company reserves the right to apply the revised rate at the respective times of payment.

Holiday Cancellation Insurance

COMPULSORY HOLIDAY CANCELLATION AND EMERGENCY EXPENSES INSURANCE
THIS INFORMATION IS VERY IMPORTANT. DO PLEASE READ IT.
We have arranged a special Holiday Cancellation insurance scheme with Travel Insurance specialists P J Hayman & Company Ltd. to cover all clients booking with us. The cost of this cover is included in your booking fee.

The following is a summary of the cover (applicable to all members of your party, as notified to us) Full details of the terms and conditions of this cover are shown in your policy document.

Cancellation Cover — up to the cost of your holiday

Insurers will reimburse your irrecoverable pre-booked travel and accommodation charges, if the holiday is necessarily and unavoidably cancelled due to a cause outside your control.
(Excess £35 per party - other than Loss of Deposit claims £10 per party)*

Curtailment Cover - up to the cost of your holiday

Insurers will reimburse the proportion of your holidays costs that are lost following the abandonment of the holiday on written medical advice. (Excess £35 per party)*

UK Helpline —Emergency Assistance

The following cover applies under this section if the Insured Person is hospitalised more than 25 miles away from usual place of residence:
• Emergency Medical Repatriation and Travel Expenses - up to £10,000 (Excess £35 per person)*
• Emergency Accommodation Expenses — up to £200
• Visit by close relative (transport costs) — up to £250
• Transportation of the deceased person — up to £1,000
• Hospital Benefit — up to £200 (£10 per day)
• Repatriation of vehicle/luggage — up to £1000

Additional Personal Insurance Benefits

The following additional Personal Insurance benefits are now included under this policy:
• Baggage B Money Cover — up to £1,000 (Money limit £150, Valuables and Single Article Limit £150 — Excess £35 per person)
• Personal Accident — up to £10,000
• Personal Liability — up to £1,000,000

Note: Health Conditions

This insurance is not subject to a health warranty, however claims are excluded where at the time of booking (taking out this insurance)
• you are aware of any set of circumstances that may lead to a claim;
• you are receiving treatment or are on a waiting list for treatment in a hospital or nursing home.
• you are expected to give birth within 14 weeks of date of arrival home;
• you are travelling against the advise of a medical practitioner or for the purpose of obtaining treatment;
• you have been given a terminal prognosis;
• is suffering or has suffered from a diagnosed psychiatric disorder, anxiety or depression.
* If the Insured Person has a pre-existing medical condition for which consultation or treatment has been received within the 6 months prior to the date of issue of this insurance, the excess under Cancellation, Curtailment and Medical Repatriation is increased to £75.
